Ordinance NO. 70

                                                             

AN ORDINANCE AMENDING ORDINANCE NO.27 (BURNING ORDINANCE) OF UNION TOWNSHIP, WASHINGTON COUNTY, PENNSYLVANIA, CHANGING HOURS FOR BURNING, ADDING A PROVISION PROHIBITING BURNING ON CERTAIN HOLIDAYS, AND INCREASING THE PENALTIES IMPOSED FOR A VIOLATION THEREOF.

 

NOW, THEREFORE, BE IT ORDAINED AND ENACTED by the Board of Supervisors of Union Township, Washington County, Pennsylvania, and IT IS HEREBY ORDAINED AND ENACTED as follows;

 

SECTON 1. That Section 4 of Ordinance No. 27 be amended to read in full as follows:

 

SECTION 4. PROHIBITION: The kindling of fires out of doors shall be permitted only upon private property; provided that

 

(a)      there shall be no violation of Section 3 of the Ordinance;

(b)     the fires thus kindled may be permitted to burn only between 7:00 A.M. and 7:00 P.M., prevailing time;

(c)      such activity shall not be permitted on Sunday, the holidays of Memorial Day, Labor Day, and the day upon which the official Fourth of July holiday is celebrated;

(d)     the fires thus kindled shall be confined to an area not closer than fifteen (15) feet to any adjoining property line or any building;

(e)      such fires shall not be left unattended

(f)       such burning shall be done in a covered, enclosed container so designed as to prevent the spreading of the fire, except for those materials or quantities which cannot be so burned.

 

SECTION 2. That Section 6 of Ordinance No. 27 be amended to read in full as follows:

 

SECTION 6 VIOLATIONS. Any person who shall violate any of the provisions of this ordinance shall upon conviction thereof. by a summary proceeding, be sentenced to pay a fine of not more than Three Hundred ($300.00) Dollars and the costs of prosecution. In default of payment of fine and costs, the defendant shall be committed to the Washington County Jail for a term not exceeding thirty (30) days.

 

SECTION 3. In all other respects the said Ordinance shall remain in full force and effect.

 

SECTION 4. All Ordinances or parts of Ordinances conflicting with the provisions of this Ordinance are hereby repealed to the extent of such conflict.

 

SECTION 5. This amending Ordinance shall become effective five (5) days after enactment.
